Why ‘lawful access’ may not be required for AI training in India

Why ‘lawful access’ may not be required for AI training in India Arul George Scaria, law professor at National Law School of India University, Bengaluru, tells *The Indian Express* what the Delhi High Court’s AI copyright ruling means for LLM training, fair dealing and potential liability for AI outputs. https://indianexpress.com/article/explained/explained-law/delhi-hc-llm-trai… *The Delhi High Court has a pending suit regarding “shadow libraries” (like Sci-Hub) despite a preliminary observation that such libraries infringe on copyright. Since LLMs are often trained on these libraries, does this present a legal grey area in India?* In *Elsevier vs Alexandra Elbakyan*, I feel the court did not have the opportunity to hear the perspectives of the academic and research community. *ANI vs OpenAI* rightly clarifies that “lawful access” is not a general requirement under the fair dealing provision, or under most of the other exceptions to infringement listed under Indian copyright law. *So if you can prove as a user that your use comes under the fair dealing exception or any of the other exceptions wherein lawful access is not mandated, the source shouldn’t really matter.* Wherever “lawful access” is intended under our copyright statute, it is specifically mentioned..... Final Reminder: T.B. Rajashekar Memorial Lecture 2026 | Wednesday, 19 August 2026, 4:00 PM IST
by Francis Jayakanth 18 Aug '26

18 Aug '26

Dear LIS-Forum Members, Greetings from the NCSI-NET Foundation. This is a gentle reminder that the 2026 T.B. Rajashekar Memorial Lecture will be held on Wednesday, 19 August 2026, at 4:00 PM (IST*)* via Microsoft Teams. Lecture Details Speaker: Ana Enriquez Head, Scholarly Communications and Copyright Penn State University Libraries, USA Title: *Conflating Copyright and Ethics* Abstract In resources about copyright law for lay audiences, it is common to conflate acting ethically with following copyright law. Rather than encouraging ethical behaviour, this trope shuts down the audience's ethical reasoning. Nor does this trope encourage learning about copyright law. Instead, it leads to several misunderstandings: it encourages people to think that all copyright wrongs are equivalent; it overlooks the variety of approaches to copyright, such as those of other countries or historical periods; and it conceals the flaws in copyright law. The solution is not to excise ethical reasoning from discussions of copyright law. The solution is to disentangle the two topics and pay adequate attention to both. About the Speaker Ana Enriquez is the Copyright Officer and Head of the Office of Scholarly Communications and Copyright at the Penn State University Libraries. As both a lawyer and a librarian, she has long advocated for improvements to the copyright system so that all may benefit from the advancement of knowledge. Earlier this year, Ana spent an academic term at the National Law School of India University, Bengaluru, as a Fulbright-Nehru Scholar. Microsoft Teams Meeting Join the meeting: https://teams.microsoft.com/meet/464418832178313?p=4NAsBoqiUfF1HVK9Dq Meeting ID*:* 464 418 832 178 313 Passcode*:* b6V3UJ7H We warmly invite all interested individuals to attend this memorial lecture. The event offers an excellent opportunity to engage with contemporary issues in copyright, scholarly communication, and research ethics, while commemorating the contributions of the late Dr T.B. Rajashekar to the library and information science community. We look forward to your participation. Best regards, Francis Francis Jayakanth On behalf of the NCSI-NET Foundation
