PAN - Indian Income Tax Act for Foreign Service Providers

Dear professionals, The (Indian) Finance Act , 2009 has incorporated a new section in the Indian Income Tax Act, 1961 which casts primary responsibility to obtain PAN ( Permanent Account Number ) on all vendors (including NRI), for their transactions in India. Many non-resident vendors do not have permanent establishments, branch offices or subsidiaries in India, and are confused about this requirement. We would appreciate it if you could share how your organization is dealing with this requirement. Appended below the relevant press release of the Govt. of India New Delhi dated 20January 2010 PRESS RELEASE 1.A new provision relating to tax deduction at source (TDS) under the Income Tax Act 1961 will become applicable with effect from 1st April 2010. Tax at higher of the prescribed rate or 20% will be deducted on all transactions liable to TDS, where the Permanent Account Number (PAN) of the deductee is not available. The law will also apply to all non-residents in respect of payments / remittances liable to TDS. As per the new provisions, certificate for deduction at lower rate or no deduction shall not be given by the assessing officer under section 197, or declaration by deductee under section 197A for non-deduction of TDS on payments shall not be valid, unless the application bears PAN of the applicant / deductee. 2. All deductors are liable to deduct tax at the higher rate in all transactions not having PAN of the deductees on or after 1st April 2010. In order that there is no dispute regarding quoting / non-quoting of PAN or accuracy thereof, the law requires all deductees and dedutors to quote PAN of deductees in all correspondences, bills, vouchers and other documents sent to each other. All deductors are, therefore, advised to intimate their deductees to obtain and furnish their PAN so as to avoid TDS at a higher rate. All deductees, including non-residents having transactions in India liable to TDS, are advised to obtain PAN by 31st March 2010 and communicate the same to their deductors before tax is actually deducted on transactions after that date. 3. The procedure for obtaining PAN is simple, inexpensive and quick. Application for PAN can be filed in Form 49A to National Securities Depository Ltd. (NSDL) or Unit Trust of India Investor Services Ltd. (UTIISL) or their intermediaries. Non-residents can apply through the local embassy / consulate of India. short report of workshop on KOHA at Central University, Kasaragode

The University Library, Central University Kasaragode has conducted a three days workshop on KOHA software during 7-9 April 2010. Around 25 participants from different libraries and Library Science departments attended the workshop. Workshop was focussed on installation and customisation of the software, both on windows and linux platforms. All sessions were very interactive and participants learned strengths of the KOHA software. First day sessions were handled by Dr Dinesan, Assistant Librarian, Central University and the second and third day by Sri. A. J. Thomson, Librarian, St. Joseph College, Devagiri. Participants were happy about the way how the workshop was conducted and they could learn more about the software. The workshop proved a great success in all respects. Attention TCS aspirants

Dear friends, As per the advertisement posted on LIS network, TCS is calling for IRC officers at various locations in India. The selection process consists of a written test and subsequently an interview. The advertisement clearly states that travel allowance will not be given for candidates appearing for written test but only for subsequent interview. I myself was a candidate for this position for the said post in the last recruitment drive. Me along with few of my friends had cleared the test and was called for interview at Chennai. Through mail they had conveyed me and my colleagues that to and fro T.A will be paid for appearing for interview. But after interview they denied us T.A.saying that we were not selected.(Nowhere in the advertisement or the call letter they say that T.A. is only for those who are selected). I am making this posting on LIS_Network not to defame TCS but to save the efforts, time and costs of those candidates who might be lured and called for interview.So dear candidates if you are called for interview think twice before deciding to appear for it....Best of luck Kannan S. Dr.Srinivas Havanur - Condolences

Dear Professionals, This is to inform the sad demise of Dr. Srinivas Havanur, a well known Librarian, research scholar and Kannada writer. He expired in Bangalore on Monday, April 5. He was 82. He is survived by his wife, two sons and a daughter. May his soul rest in peace on eternity. A brief account of Dr.Srinivas Havanur: He started his career as a librarian with the Baba Atomic Research Centre in Mumbai. In 1984, he resigned his post to join the University of Mangalore as the Head of Department of Kannada, and in 1986 he took charge of the Department of Kannada in the University of Bombay. He wrote about 60 books, including short stories, novels, essays and literary criticism. His work, "Hosagannadada Arunodaya", is said to be an important text for those who wish to research Kannada language and culture. He has earned several honours such as the Rajyotsava Award, Kannada University's, Hampi, Nadoja, Alva's Nudi Siri and Sandesha awards.
