The European Copyright Directive does not prevent the digitization of books in a library’s collection if those books are made accessible to the public on dedicated terminals, wrote Advocate General Niilo Jääskinen in a formal opinion <http://curia.europa.eu/jcms/upload/docs/application/pdf/2014-06/cp140078en.…> to the Court of Justice of the European Union (CJEU). Under the directive, member states must grant authors the exclusive right to authorize or prohibit the reproduction of public works. But there are specific exceptions that apply to libraries which are allowed to make books public for the purpose of research or private study, he said. Digitization of library books may be necessary to protect original works that are still copyrighted but are too old, fragile or rare to make available to a large number of students or when photocopying might result in disproportionate wear, Jääskinen wrote. The directive only permits libraries to digitize individual works though, and does not permit the digitization of an entire collection, he said. Users are not allowed to save the digital book to a USB stick, since that isn’t a communication by the library but the creation of a private digital copy by the user, Jääskinen said. However, the directive in principle does not prevent the book from being printed as a private copy, he added. There is no difference in photocopying a book that is physically present in a library and printing a digital copy of the same book, he said. The risk of unlawful distribution on a large scale which is present with digital copies does not exist in the case of printed paper copies, he said. The Advocate General gave his opinion in a case that was referred to the CJEU by Germany’s Federal Court of Justice. The Germans asked Europe’s top court to clarify the precise implications of Europe’s Copyright Directive in a dispute between the Technical University of Darmstadt and the German publishing house Eugen Ulmer. The university digitized one of the publisher’s textbooks and made it available to students on a terminal while refusing to purchase the ebook version of the book. Eugen Ulmer asked the court to forbid the digitization of the book and prevent students from reading it on a terminal, printing it or saving it on a USB stick. Jääskinen however is of the opinion that even when a rights holder offers the library a license agreement for ebooks, the library can still show a self-made digital copy on dedicated terminals. While the Advocate General’s opinion is not binding on the Court of Justice, the court ruling usually follows his independent advice. This is not always the case though. IASLIC 26th National Seminar 2014 – Call for papers IASLIC takes it as an opportunity to express its gratefulness to the Government of India for constituting the National Knowledge Commission (NKC) envisioning that creation, development and use of multidimensional knowledge are key factors for the steadfast growth of the economy. IASLIC also feels obliged for the report of the Working Group on Libraries under NKC, entitled “Libraries – Gateway to Knowledge: A Roadmap for Revitalization” and its recommendations for fostering the development of library and information science and services in India. The report rightly indicates that ‘Libraries have a recognized social function in making knowledge publicly available to all. They serve as local centres of information and learning, and are local gateways to national and global knowledge’. As per the recommendation of the National Knowledge Commission (NKC), the National Mission on Libraries (NML), the first ever of its kind across the Globe, has been constituted as a High Level Committee for achieving the primary goals of LIS - Creating, disseminating, optimally utilizing and preserving knowledge. They are instrumental in transforming an unequal society to an egalitarian, progressive knowledge society. IASLIC has initiated a nationwide discussion and Library professionals across the country would actively participate in this discussion to find a roadmap which would help NML and the Govt of India to see the dawn of Knowledge Society in true sense. A delegation from IASLIC has given representation to the Minister of Culture, Govt of India and expressed its views to this regardt. Which University is Good or Bad for PhD?

Dear Library Professionals, This is regarding some comments and suggestions on PhD Research Work. Some professionals argued that deemed universities are bad and government universities are good and hence students should enroll for PhD only in the govt. It is not the right presumption that all govt. universities are good and all deemed universities are bad. In Kerala, we have 13 govt. universities and none of them have university librarians to look after their Library Systems. It is also to be noted that four of these universities not even established the University Libraries (Ref: Francis, A.T. 2014, Library and information systems in universities and quality of higher education and research. University News, 52(20), May 19-26, 2014, 8-13 & 21). So, it should be the first concern of the LIS professionals and Associations to establish good libraries with adequate facilities and library professionals in all schools, colleges, universities and research agencies. Another concern of the professionals was on the language of writing thesis. There is no harm in writing thesis in any language. But it should be as per the academic regulation of the concerned university. If the university permits writing LIS thesis in Malayalam, students can do accordingly. If the student decided to write LIS thesis in Malayalam, he/she should strictly follow the grammar and structure of Malayalam. That is why universities/experts insist thorough editing/checking of the topic/subject, quantitative analysis; and the last one, but not the least, the language editing. I am having the qualifications, MCom, MLISc, NET and PhD (CochinUniversity). I had to wait for 12 years to obtain a Research Guide for PhD. Hence, it is my humble request that please encourage our fellow professionals to do PhD and be good librarians with personal and social status. As majority of the librarians and former librarians in Kerala (not in universities and colleges) are non professionals without any professional qualifications, people generally think that librarians did not have any valid qualifications and the job of librarians need any expertise. If no skill is required for our job, Existence of LIS departments is also under question,. I am a research guide of several universities, including the KarpagamUniversity and BharathiarUniversity. Eight (maximum) students are doing PhD research under me and several students are struggling to get a slot for PhD. So, evaluating a university should be based on its facilities, academic regulations and not on personal grounds. With regards, Dr. A.T. EBSCO Information Services President Tim Collins say the expanded partnership with Innovative is a great example of two library vendors working together to benefit customers. The continuing success of our partnership with Innovative is a testament to what two vendors can accomplish when they decide it is in their collective best interests to develop solutions that leverage their strengths and, most importantly, serve the needs of their customers." The existing agreement has provided for joint development designed to enable more tightly integrated access between Innovative's Encore discovery platform and EBSCO Discovery Service <http://www.ebscohost.com/discovery> (EDS) in addition to facilitating access between EDS and Innovative's Sierra Services Platform. Having access to EDS's unified index expands the quality and amount of content available for Encore users while adding the enhanced features and functionality available from EDS. Encore users are also able to search their EBSCOhost databases via the Encore interface--providing a uniquely powerful article search experience. The partnership has also led to the development of the newly released Encore with EBSCO Discovery Service, which brings the most comprehensive collection of full-text articles available into Encore. The robust metadata offered by EDS is culled from thousands of major journal publishers and information providers, providing the deepest possible indexing for the majority of journals and magazines. In addition, users of Encore with EBSCO Discovery Service benefit from more full-text resources than with any other option. NOTICE The esteemed members of the Association are hereby informed that we have been publishing IASLIC Newsletters in electronic format (since 2011) in addition to its monthly hardcopy editions. Many of you have welcomed the effort. Due to rising printing and postage costs, the association is facing financial constraints in publishing hardcopy editions of the newsletter. To overcome the situation we had appealed to our members for generous donations (Rs 1000/- or more). But the responses are not satisfactory. In this situation, some members present at the Annual General Meeting held on 27.12.2013 at Pune suggested publication of newsletter in electronic format only from July, 2014 issue, while some members opposed this view. In the circumstances it was resolved to send electronic version of the newsletter to those who have necessary access facilities.Hence our humble request to our fellow members is to let us know their present e-mail addresses to the office of the IASLIC through e-mail (iaslic.news(a)gmail.com) immediately for our record.
