This is in continuation of the ongoing discussion and what Mrs. Swati Bhattacharyya and Mukesh Jha has written:
CONTU guidelines permit a borrowing library to receive up to 5 articles from a periodical title (not a single issue) per calendar year.
However, If your institution library has licensed (not purchased) the content/material, the license agreement is a binding and overrides all other restrictions. Also, your library License agreements and subscriptions from publishers may limit content reuse more strictly than copyright law or the CONTU guidelines.
What should librarians and consortia managers do to be copyright compliant? - Negotiate and insert appropriate clause to your license agreements before you start sharing your documents with other libraries.

This matter has been discussed, time and again, on this list.
Requesting for one or two articles may be alright. But requesting for the soft copy of the whole thesis which is almost equivalent to a book and produced by Proquest, is certainly violating copyright. I hope others too agree.
